Suspension of enforcement proceedings

Suspension of execution is admissible both for the entire enforcement proceedings and for a specific enforcement action. The creditor may appeal the act of the bailiff for suspension before a district court. In the case of a suspended case, enforcement actions cannot be carried out - inventory and sale of property, transfer of movable property, preparation and presentation of distribution of sums, as well as their payment.

The suspension of the enforcement proceedings has the effect of suspending all the periods that are running in the case, including the statute of limitations. Except when the creditor has suspended the performance at his request, the two-year period of limitation runs, unlike the other suspension hypotheses.

Suspension of execution occurs in three possible ways - through an act of the bailiff; by a judicial act ordering the suspension, as well as by virtue of the law.
